Please explain the following: In regards to on the San Diego Fires and considering Palsgraph, what element of negligence is in question? The elements of negligence are: Duty, Breach, Causation and Damages. Torts is one of those areas where people can agree to disagree, especially when it comes to damages and comparative negligence. How does this apply to the guy who set San Diego on fire?
